While I'm far from an expert in intellectual property, one of the challenges may be the non-obvious requirement, which I imagine will be a key defense from the people you are looking at. Always liked intel property, even in law school, and actually taught it for almost 10 years at the undergrad level, but never practiced in the field, preferring to fight crime instead.
That link I sent you addresses one of my major problems during skiing- having to remove gloves when using an ipod (unless you use a remote control device, problematic itself. Apple, innovative as usual, is working on it. Simple problems with non-trivial solutions are fascinating, much like the problems you address with your clothing. Questions: what do you carry while skiing, what specific items making skiing more fun and easier for you? Any gadgets, gismos, etc? Regards, jason a.
I am not worried about the obvious part, for a variety of reasons, not the least of which is if it were obvious they would have done it sooner, and obviousness is taken into account when granting a patent. Of course it will be raised but my attys are not worried about that at all.
I hear you re controls on ski jacket. Personally i use a remote through my Shure headpones to my iphone/itouch. It allows me to easily click with my gloves to pause, and/or double click to move to next song, which is about all the controls i need.
I just ordered this: Eforcity FM Radio Remote for Apple iPod 3G/ 4G /
Only $8 and seems perfect. I don't believe the softswitch solution for a variety of reasons, but think either sure, or this, makes most sense. I will let you know what i think of it after i get it
I hear what you are saying about obviousness, and I agree, I would hope that they would choose licensing rather than fighting, but considering the ridiculous wars you've had to fight with IBM and such over an "e", rationality is sometimes lacking in a corporate environment (as a former corporate lawyer you probably know this better than most)
On my next ski trip in a couple weeks I'm going to use the belkin sportscommand, http://www.amazon.com/Belkin-SportsCommand-Wireless-Control-iPod/dp/B000I67Z6S/ref=pd_bbs_sr_1?ie=UTF8&s=electronics&qid=1231032832&sr=8-1
I'm going to borrow it from a friend who raves about it. Love ipods, but not a total Apple person, as mac and iphones not for me yet. Have to admit, they are elegant but I still use a tricked out Treo 650 with a 16g Sd card. I have a pair of headphones with the clicker and volume accessible with ski gloves. Vail better watch out.
Hi Scott...that was a beautiful day out on the trail, nice to finally meet you, though it was from a distance. I was skate skiing with my new iPhone, nice to have merged 2 gadgets into one, phone and iPod, new experience for me. I use the headphone button too which is a great feature. I have yet to find a wireless product that delivers the sound quality I love so for me until someone figures that out I'm still "wired".
While I've never held a patent for products I've designed I have held trademarks and copyrights. It's important to actively protect your patent with notifications of infringement but I've always felt it wiser to beat "them" in the market place. I've been an Apple user for 20 years and when Verizon tried to entice me with their iPhone knockoff to stay with their service I wasn't even close to interested. Why? because of my product loyality. You have the edge with TEC. There will always be copycats. Put your energy into creating the "next best thing".
Love your site, really great looking, compliments the product. I like too how you have simplified the navigation.
Took a look at the Eforcity...seems a little bulky. Let us know how you like it.
